National Teaching Council (NTC) Privacy Notice

General Overview

Your privacy is important to us at NTC. We respect and care about how we process your personal information given or shared with us to fulfil the purpose of our Legal mandate and providing services to you. This Privacy Notice provides you with the information about how we process, share, protect your personal information in line with our obligations and your rights under the Data Protection Act 2012 (Act 843), GDPR (General Data Protection Regulation) and other African jurisdictions.

 

Who we are

The National Teaching Council, (NTC) is a government agency established by the Education Regulatory Bodies Act 2020 (ACT 1023) under the Ministry of Education (MOE) with the legal mandate of regulating the Teaching Profession in Ghana

Unless otherwise stated, NTC is the Data controller for the Information we process and, a Data Processor. The National Teaching Council shall be referred to as “NTC” for the purposes of this privacy notice.

How we obtain your personal data

Depending on the nature of your interaction with us, NTC collects personal information directly from you when you engage us. Also, from third parties such us our controlled affiliates, service providers and accredited institutions.

These are when you:

• register to acquire licence
• register to sit for Ghana Teacher Licensure Examination (GTLE)
• register for Ghana Teacher Prize (GTP)
• visit our office and surveillance CCTV is used
• contact us to make an enquiry or visit our office
• you make a complaint and or give feedback
• register to attend a workshop or a program
• apply for a job with us
• visit our website.
• share your personal information with us by our controlled affiliates
• use any other interaction that you have with us

 

Personal Data we collect

As a result of your actions stated above, we will only collect personal information that is necessary, relevant and not excessive for the purposes of processing. The type of personal information that we may collect and process about you when you interact with us include the following:

• Your name
• Telephone number(s)
• Email address
• Address (postal, digital, or physical)
• SSNIT ID
• Date of birth
• Place of Birth
• Hometown
• Staff ID
• Registered or License Number
• School Index Number
• Passport Picture
• Video (CCTV)
• Cookies
• IP address
• Ghana Card

We may in certain circumstances process other information such as your subscriptions, services used, records of conversations, agreements and financial details that are required for transactions.

 

Purpose of processing

The purposes for which we process your personal data include one or more of the following, to:

1. enable us to issue you with license or certification
2. enable us use it for examination purposes
3. enable us give Prize awards to Ghanaian Teachers
4. provide information that you ha requested, or we think may be relevant to a service or product you have exhibited an interest.
5. Interact with you to enable us process financial transactions for you or the company that you represent for the purchase and commissioning of services from us.
6. fulfil a contract that we may have entered with you or the entity that you represent.
7. ensure the security safeguard of our websites and underlying business infrastructure.
8. manage any communication between you and us

 

Lawfulness and Consent

We respect your personal data and we will ensure it is processed in a lawful and reasonable manner without infringing on your privacy rights as always guaranteed under the Data Protection Act 2012, (Act 843).

NTC will only process your personal data for the specific purpose that we stated at the point of collection and what the law (Education Regulatory Bodies Act 2020, (ACT 1023)), requires us to do.

We will only process your personal data in a way which is necessary, relevant and not excessive. We shall through all means ensure you are always informed on how your data is being processed.

Be rest assured that your data shall not be processed without your prior consent unless:

• It is necessary for the purpose of a contract to which you are a party.
• Authorized or required by law
• Necessary for the proper performance of your statutory duty
• To protect or necessary to pursue legitimate interest of you or NTC

You reserve the right to withdraw your consent at any time. However, we may not be able to provide you with some services when you withdraw your consent. Whereas this is the case, we will advise you at that point of withdrawing your consent.

 

Retention (How long we keep your data)

NTC shall not keep your data for a period longer than necessary to achieve the purpose for which we process your data according to our retention policy. At the end of the retention period, your data will either be deleted completely or anonymised (so that it can no longer be associated with you) for example by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and NTC business planning. We may use this retention policy indefinitely without further notice to you once you no longer have any business with us or otherwise.

Specific details of the retention periods of your personal data are available upon request.

 

Who might we share your Personal Data with?

We will not share your information with third parties unless any of the following circumstances applies.

• Where we have sought and obtained your consent to the disclosure of same or where the initial disclosure was made for the purposes of it being made available to the public, under the provisions of Education Regulatory Bodies Act 2020, (ACT 1023).
• Where the law or a statutory duty requires us to do so or to respond to legal process, to protect lives, rights and property.
• We may also share your data with NTC ‘s-controlled affiliates for providing services.
• Our internal team members who need the information during their roles to administer a contract or service we are providing to you
• If we need to share personal data to establish, exercise or defend our legal rights (this includes providing personal data to others for the purposes of preventing fraud and reducing credit risk).
• Share with recipients including employees only for the purposes of administering services to you or respond to your request.  This will only be shared on a strictly need to know basis.
• We will only share with third parties that we have either contracted to perform services for us and will ensure that we put the necessary security and third-party contracts agreements in place.

Security safeguards and Cookies

Security safeguards are of high importance to us and therefore we believe we have appropriate technical and organizational security measures in place to protect your information.

NTC will not be liable for your electronic and non-electronic privacy settings. We do not, however, have any control over what happens between your device and the boundary of our information infrastructure. You should be aware that there are many information security risks that exist and take the appropriate steps to protect your own information.

We use “cookies” to enhance the use of our website when you visit our website for interaction and services which are steps to data safeguards.

“Cookies” may be used to track, store, and analyse your behaviour from your browser when you visit our website. They cannot access data on your hard drive or transfer viruses to your computer or mobile device.

Your Rights as a data subject.  

The Data Protection Act 2012, (Act,843) provides some basic rights to data subjects.  These are,

Right to be informed:

You have the right to be informed about the processing of your personal information (personal data) that we possess.  This privacy notice is a way of ensuring we meet our obligations to enable you to exercise your right to be informed.

Right to Access Your Personal Information

You have the right to access the personal information we hold about you. This is sometimes termed a ‘Data Subject Access Request.’ We will ask for proof of identity and sufficient information about your interactions with us so that we can locate your personal information when you make such a request. Right to rectification, blocking, erasure, and destruction

Where information we hold about you is inaccurate, incomplete, or out of date, you may inform us to correct or update it at any time.  You also have the right to block us from further processing of your personal data where we do not have any legitimate or legal basis to do so. In certain circumstances, you may also ask us to delete your personal data.   The right to erasure or destruction is not absolute and only applies in certain circumstances. If you would like to exercise any of these rights, please contact us.

 

Right to prevent processing: 

Under this right, you can give us a notice in writing or email to cease processing your personal data for a specific purpose or manner which will cause or likely to cause any unwarranted damage or distress.  You can also prevent us from processing your information for direct marketing purposes.

 

 Right to complain, compensation and the supervisory authority

The Data Protection Commission (DPC) regulates data protection and privacy matters in Ghana. They make a lot of information accessible to citizens or consumers on their website and they ensure that the registered details of all data controllers, such as us, are available publicly.

Other Rights under different jurisdictions Across Africa and beyond

NTC will ensure the various rights of data subjects or citizens data we process are respected and take our obligations under the law seriously. Where we process personal data of other jurisdictions, we undertake a privacy assessment to identify any potential risk of noncompliance.

 

Notice to Exercise Rights

You can at any time give notice in writing to us to exercise your rights.  We will within twenty-one (21) working days after receipt of your notice, inform you by writing that we have or intend to comply with the notice  or give reasons if we cannot comply with the request.

 

Governing Law and Jurisdiction

This privacy notice is governed by the Laws of Ghana and the Data Protection Act 2012,     ( Act 843).  Any legal issues or actions arising in connection with this privacy notice, will be submitted to the Jurisdiction of the Ghanaian Legal System.

Changes to this Privacy Notice

We may change this Privacy Notice from time to time. This may be necessary, for example, if the law changes, or if we change our business in a way that affects personal data. Any changes we make will be published and indicated by a version number. We therefore encourage that you review our privacy policy regularly for update.

We adhere to the General Principles of Data Protection and general International best practices in relation to Data Protection and not only guided by Act 843
